PGC Tour - Terms of Service

Welcome to PGC Tour (“we”, “our”, “us”). By accessing or using our mobile application (“App”), website, and related services (collectively, the “Service”), you agree to comply with and be bound by these Terms of Service (“Terms”). Please read them carefully before using our Service. If you do not agree to these Terms, you must not access or use our Service.

1. Acceptance of Terms

By downloading, installing, or accessing the PGC Tour App or using the Service, you agree to these Terms and any updates or modifications made to them. We may update these Terms at any time, and any changes will be effective immediately upon posting on this page. Your continued use of the Service constitutes your acceptance of such changes.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet the age requirement and have the legal capacity to enter into a binding agreement.

PGC Tour provides a fantasy golf experience where users can create fantasy golf teams, participate in leagues, and engage in other golf-related activities. You agree to use the Service in a lawful and respectful manner, and not to:

  • Violate any local, state, national, or international laws.
  • Engage in any conduct that is harmful, fraudulent, abusive, defamatory, or otherwise objectionable.
  • Attempt to gain unauthorized access to the Service or any related systems or networks.
  • Use automated means (e.g., bots, scrapers) to access the Service without our express consent.

5. Ownership of Content

PGC Tour and its licensors retain all rights, title, and interest in and to the Service, including all intellectual property rights. You may not use any part of the Service, including its content, design, and functionality, for commercial purposes without our express permission.

6. User Content

By using the Service, you may submit or upload content, such as team rosters, league participation data, and other information (“User Content”). You retain ownership of your User Content but grant PGC Tour a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with the Service.

You agree not to post or upload any User Content that:

  • Violates any intellectual property rights, privacy rights, or other legal rights of third parties.
  • Contains harmful, offensive, or illegal material, including hate speech, pornography, or spam.
  • Is false, misleading, or otherwise deceptive.

7. In-App Purchases and Payments

PGC Tour may offer certain features or premium content for purchase within the App. All payments are processed through third-party payment processors. By making a purchase, you agree to comply with the terms and conditions of the third-party provider. All fees are non-refundable except as required by applicable law.

8. Fantasy Golf Contests and Leagues

If you participate in any fantasy golf contests or leagues hosted on the Service, you agree to the following:

  • You will comply with the rules of the contest or league as provided by PGC Tour.
  • You will not engage in any form of cheating, collusion, or fraudulent activity.
  • All winnings, if any, are subject to applicable taxes. You are responsible for reporting and paying any taxes related to your winnings.

9. Prohibited Conduct

You agree not to:

  • Interfere with the operation of the Service or disrupt the experience for other users.
  • Engage in any activity that may harm or damage the reputation of PGC Tour.
  • Use the Service to transmit viruses, malware, or other harmful code.

10. Termination

PGC Tour reserves the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the Service.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without any warranties or guarantees. PGC Tour does not guarantee that the Service will be error-free, uninterrupted, or secure. You use the Service at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, PGC Tour, its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising out of or in connection with your use of the Service.

13. Indemnification

You agree to indemnify and hold harmless PGC Tour and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys‘ fees) arising from your violation of these Terms or your use of the Service.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which PGC Tour is based.
